Who needs a Fictitious Name?
If you plan to transact business under a fictitious name, you must
file a Fictitious Business Name Statement at least 40 days before
beginning operation. A name is considered fictitious if it doesn't
contain the business owner's surname, or if it contains words other
than those in the owner's full name. For example, if the owner's
name is Sally Smith, the names "Sally Jones," "Sally
Smith Shoes" and "Sally Smith and Company" are fictitious.
What are the benefits of a Fictitious Name?
Registering your business name protects you from other businesses
that might want to use the same name. It also prevents your competitors
from using your name.
How do I obtain a Fictitious Name?
1. Contact the San Mateo County Clerk at (650) 363-4403 to ensure
no one else has registered your intended business name.
2. Ask the County Clerk for a Fictitious Business Name Statement,
and fill it out.
3. Return the form to the County Clerk, along with a $28.00 Filing
Fee for the first Business Name and Registrant, and $5.00 for each
additional Business Name and Partner.
4. Publish your Fictitious Business Name Statement in a court-approved
newspaper once a week for four consecutive weeks. This must be done
within 30 days of filing your statement.
